HB 51 instructs all Georgia postsecondary institutions to report an information reasonably believed pertinent to a felony crime committed by an enrolled student, in or on properties oversee by the institution to law enforcement. If the felony involves an alleged sexual assault, the victim's identifying information is kept private.
The bill prohibits an investigation of the alleged offense by the college/university unless the investigation is conducted by campus police and the agent is POST certified.
The legislation also requires colleges and universities to provide hearings and due process to students facing disciplinary action because of alleged felonies and/or sexual assaults. The disciplinary action cannot be used as part of the criminal case.More information on legis.ga.gov
