SB 126: State Tort Claims; venue of actions; provisions; changeVoted on Tuesday March 28, 2017
John Pezold's thoughts
I was excused and did not vote on SB 126 which amends code section relating to venue of actions by adding certain specifications. Currently, tort action against the state must be brought in the state or superior court of the county where the loss occurred; SB 126 requires tort action against the state be brought in the state or superior court of the county where the tort that gave rise to the loss occurred. Wrongful death actions may be brought in the county where the tort giving rise to the loss occurred or the county where the decedent died. The bill affects causes of action filed on or after July 1, 2017.More information on legis.ga.gov
