SB 137: Child Support Recovery Act; federal Deficit Reduction Act of 2005; require the obligor to pay the full feeVoted on Tuesday March 28, 2017
John Pezold's thoughts
SB 137 amends child support code by amending the fees payable to the Dept. of Human Services for the collection of child support payments.
Currently, the Code allows the Dept. of Human Services to charge a federal 'Deficit Reduction Act of 2005' fee of $25 as the annual maintenance fee for the collection of child support when the total collection amount exceeds $500. The fee is divided to $12 for the custodial parent and $13 for the non-custodial parent for each case.
This bill assigns the full $25 to the non-custodial parent and applies only if the custodial parent has never received adoption assistance payments or medical assistance payments under the Social Security Act. The Dept. of Human Services collects the fee through income withholding or any other method available to the department.More information on legis.ga.gov
